2. Our Services

Depending on the booking, HikingGuide.es provides or arranges:

  • Guided hiking holidays
  • Self-guided hiking holidays
  • Guided e-bike holidays
  • Self-guided e-bike holidays
  • Accommodation
  • Airport transfers
  • Daily transport
  • Route planning
  • Maps, route notes and GPX files
  • Local support and associated holiday services

The exact services included in a booking are those described on the relevant holiday page and booking confirmation.

3. Booking, Deposits and Payment

A booking is confirmed when HikingGuide.es accepts the booking and receives the required deposit or full payment.

The standard booking deposit is €200 per person, unless a different amount is stated for a particular holiday.

The remaining balance is normally due 14 days before arrival, unless otherwise stated in the booking confirmation.

Customers are responsible for checking that names, dates, passenger information and other booking details are correct.

4. Cancellation by the Customer

You may cancel the holiday at any time before it starts by notifying us in writing.

Where Spanish or EU package-travel law applies, we may deduct an appropriate and justifiable cancellation charge. The charge will reflect the timing of the cancellation, non-recoverable commitments already made, costs we save and any income obtained by reselling the services. We will provide a justification of the amount on request.

More than 30 days before the holiday:
Payments will normally be refunded, less any appropriate and justifiable charge for non-recoverable costs.

30 days or less before the holiday:
The cancellation charge may be substantial and may reach the amount already paid, but only where the actual commitments, lost resale opportunity and applicable law justify it. It is not an automatic flat forfeiture.

The standard €200 booking deposit may normally be transferred once to another available HikingGuide.es holiday, subject to availability. This goodwill option does not restrict any mandatory refund right.

No-show, late arrival, unused activity days or voluntary early departure will normally attract the same reasonable-cost assessment.

Unavoidable and extraordinary circumstances: where such circumstances occur at the destination or its immediate vicinity and significantly affect the performance of the package, or significantly affect passenger transport to the destination, you may terminate before departure without a cancellation charge and receive a full refund of payments for the package. No additional compensation is due in that situation. Any legally required refund will be made without undue delay and no later than 14 days after termination.

Our full arrangements are in the Refund & Cancellation Policy. Nothing in these terms removes mandatory Spanish or EU consumer and package-travel rights.

5. Travel Insurance

All customers must hold suitable travel insurance covering the activity they are undertaking.

For hiking holidays, customers must ensure their insurance appropriately covers hiking and mountain walking.

For e-bike holidays, customers must ensure their insurance appropriately covers cycling/e-biking and the type of terrain being ridden.

Insurance should include, where applicable:

  • Emergency medical treatment
  • The booked activity
  • Search and rescue
  • Medical evacuation
  • Repatriation
  • Holiday cancellation or curtailment

Customers will be asked to provide insurance information as part of their participant form.

It is the customer’s responsibility to ensure that their policy provides adequate cover.

6. Health, Fitness and Participant Information

Customers must provide accurate information regarding anything that could reasonably affect their ability to participate safely, including relevant:

  • Medical conditions
  • Injuries
  • Allergies
  • Medication
  • Mobility issues
  • Fitness
  • Hiking or cycling experience

Customers must inform us if this information changes before or during their holiday.

Medical and health information is handled in accordance with our Privacy Policy.

7. Hiking and Outdoor Activity

Hiking and mountain walking take place in natural environments and involve inherent risks.

These may include uneven ground, loose rocks, steep terrain, slips and falls, heat, cold, changing weather, wildlife and other natural hazards.

Participants are expected to follow reasonable safety instructions from their guide and behave responsibly.

No outdoor activity can be made completely risk-free.

8. Guide Decisions

The guide is responsible for making operational decisions concerning guided activities.

The guide may change, shorten, relocate or cancel a planned route where appropriate because of:

  • Weather
  • Extreme heat
  • Storms or strong winds
  • Trail conditions
  • Fire risk
  • Flooding
  • Conservation restrictions
  • Park or trail closures
  • Group ability or fitness
  • Other reasonable safety considerations

Safety takes priority over completing a particular route.

9. Flexible Itineraries

The routes and itineraries shown on HikingGuide.es are representative examples.

The Sierra de Grazalema is a protected natural environment and access to individual trails can vary throughout the year.

Routes may therefore be changed according to weather, trail access, conservation restrictions, seasonal conditions and group ability.

Customers book the overall holiday rather than a guarantee that every individual trail displayed on the website will be completed.

10. Weather

Outdoor activities are weather dependent.

Unsuitable conditions affecting a particular route do not automatically create an entitlement to a refund where a reasonable alternative programme can be provided.

We will always attempt to make appropriate use of the available conditions while putting participant safety first.

11. Self-Guided Holidays

Customers participating in a self-guided holiday undertake routes independently.

We provide route planning, maps, GPX information, local knowledge and support as described in the booking.

The customer remains responsible for:

  • Following the route appropriately
  • Monitoring their surroundings and conditions
  • Making sensible decisions while walking or riding
  • Carrying suitable clothing, water and equipment
  • Contacting us or emergency services when appropriate

Customers should not continue a route where they reasonably consider conditions unsafe.

12. E-Bike Holidays

Customers using our e-bikes must follow the safety and operating briefing provided.

Customers must:

  • Ride responsibly
  • Follow applicable traffic laws
  • Use appropriate safety equipment
  • Tell us about mechanical problems
  • Not deliberately misuse or modify the bike
  • Not allow an unauthorised person to use the bike

Customers may be responsible for loss or damage caused through deliberate misuse, reckless behaviour or negligence.

Normal wear and tear and mechanical failure not caused by the customer remain our responsibility.

13. Accommodation

Where accommodation is included, the accommodation arrangements will be described in the booking.

Unless specifically stated otherwise, customers may receive a private bedroom within shared accommodation.

Common areas such as kitchens, living rooms, terraces and bathrooms may be shared.

Customers are expected to treat accommodation and its contents with reasonable care.

14. Airport Transfers and Transport

Airport transfers and local transport are included where stated in the relevant holiday description.

Customers must provide accurate travel details.

Flight delays, cancellations, missed connections and changes outside our control may require alternative transfer arrangements and may result in additional costs.

15. Participant Conduct

We may refuse or terminate participation where a customer:

  • Behaves dangerously
  • Repeatedly ignores reasonable safety instructions
  • Is seriously disruptive or abusive
  • Is under the influence of alcohol or drugs
  • Deliberately provides materially incorrect safety information
  • Places themselves or other people at unreasonable risk

Where participation is terminated because of the customer’s own serious misconduct, no refund will normally be due.

16. Cancellation or Changes by HikingGuide.es

Very occasionally we may need to make significant changes to or cancel a holiday.

Where we cancel contracted services and cannot provide an appropriate alternative, customers will receive the refund, alternative arrangement or credit applicable under the circumstances and required by law.

17. Unavoidable and Extraordinary Circumstances

Natural disasters, wildfires, serious weather events, government restrictions and other unavoidable and extraordinary circumstances can occasionally affect travel and outdoor activities.

Where applicable, the rights of the customer and HikingGuide.es will be determined in accordance with Spanish and European consumer and package-travel legislation.

18. Statutory Package Travel and Consumer Rights

Nothing in these Terms & Conditions affects mandatory consumer rights.

Where a booking legally constitutes a package travel contract, the relevant provisions of Spanish and European package-travel legislation apply and take precedence over any conflicting provision in these Terms.

19. Photography and Marketing

Photographs and videos may occasionally be taken during activities.

Customers may tell us that they do not wish to appear in promotional material.

Where consent is legally required for identifiable marketing use, appropriate consent will be obtained.

20. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under Spanish or European Union law.

HikingGuide.es is not responsible for losses arising solely from circumstances outside our reasonable control except where applicable law provides otherwise.

21. Governing Law

These Terms & Conditions are governed by Spanish law.

Any dispute will be dealt with by the competent courts determined under applicable law, without prejudice to mandatory consumer rights.
